An amendment to Article 266 of the Code of Civil Procedure proposed by the Legal Commission of the Council of States triggered a one-sided and unbalanced debate. Lawyer Manuel Bertschi, who works for Zulauf Partner, writes in his article published on Medialex on June 4, 2021, that the «assassination attempt on freedom of expression» criticized by lawyer Schwaibold is just as wrong as the accusation of «censorship». Obtaining precautionary legal protection against media reports is very difficult in Switzerland. Manuel Bertschi considers the balance of power between the media and those affected by the media, aimed at by the Council of States’ legal commission, to be generally welcome, but suggests other options for action.
